The Supreme Court on Friday dismissed a petition seeking a revision of the Employees' Provident Fund (EPF) wage ceiling, noting that the Union Cabinet had already approved raising the mandatory coverage limit to Rs 25,000 per month . A bench comprising Justices B V Nagarathna and Augustine George Masih observed that the petitioner's prayers had been granted following the government's decision. 'We saw in the newspapers. All your prayers have been granted,' the bench told the advocate appearing for the petitioner .

The judicial development follows the Union Cabinet's approval on September 16 to enhance the statutory wage ceiling for mandatory coverage under the Employees’ Provident Fund Organisation (EPFO) from Rs 15,000 to Rs 25,000 per month . Information and Broadcasting Minister Ashwini Vaishnaw announced the decision, stating that the new ceiling would take effect from September 17, coinciding with Vishwakarma Day. The Ministry of Labour and Employment subsequently issued Gazette Notification S.O. 5109(E) to formalise the revision .

The previous ceiling of Rs 15,000 had remained unchanged since September 2014, while the limit was entirely static between 2004 and 2014 . The revision is projected to bring over 51 lakh additional employees into the mandatory EPFO framework, significantly expanding social security protection for workers in the Rs 15,000 to Rs 25,000 monthly wage bracket . These workers will now receive statutory benefits under the Employees’ Provident Fund, Employees’ Pension Scheme (EPS), and Employees’ Deposit Linked Insurance Scheme (EDLI) .

Consequently, the maximum employer pension contribution at 8.33 per cent will increase from Rs 1,250 to Rs 2,083 per month. The annual government outgo for this enhancement is estimated at approximately Rs 11,339 crore, up from the existing budgetary support of Rs 10,250 crore. The estimated expenditure over five years is approximately Rs 56,696 crore .

The Supreme Court petition had originally sought directions for a dynamic formula or objective criteria for future revisions of the wage ceiling, linking it to economic indicators such as inflation, minimum wages, and the consumer price index . While the court did not mandate a permanent dynamic formula, the executive decision addresses the immediate stagnation in the wage threshold. According to FAQs released by the EPFO, employers must apportion wages for September 2026, calculating contributions separately for the periods before and after September 17 .

The transition may temporarily impact take-home salaries for employees in the newly covered bracket, though the EPFO notes that the increased employee share is fully matched by the employer and accrues tax benefits. The Ministry of Labour and Employment and the EPFO are undertaking the necessary statutory and administrative steps to ensure seamless implementation across the country's 7.68 lakh contributing establishments . Regional offices have initiated dedicated helpdesks and awareness webinars to assist employers and workers with the transitional compliance requirements .
